These Terms of Service ("Terms") govern your use of Legacy Landscaping's services and define the relationship between you and Legacy Landscaping. By requesting an estimate or engaging our services, you agree to comply with these Terms. Please read them carefully.
By requesting landscaping services from Legacy Landscaping, submitting payment information, or beginning any landscaping project with us, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to any portion of these Terms, you should not engage our services.
Legacy Landscaping provides professional landscaping services including, but not limited to: lawn maintenance, landscape design, hardscaping, tree and shrub care, irrigation installation and maintenance, seasonal services, and related outdoor property improvements. The specific scope of work will be detailed in a written estimate or service agreement prepared by Legacy Landscaping.
All estimates provided by Legacy Landscaping are valid for thirty (30) days from the date of issuance. Estimates are based on information provided by the client and site conditions observed at the time of assessment. Estimates are subject to change if:
We will notify you of any cost adjustments and obtain written approval before exceeding the original estimate by more than 10%.
Payment terms are determined on a project-by-project basis and will be clearly outlined in your service agreement. For ongoing maintenance contracts, monthly invoices are due within fifteen (15) days of receipt. A late payment fee of 1.5% per month (or the maximum allowed by Colorado law) will apply to overdue balances. We reserve the right to suspend services if payment is more than thirty (30) days overdue.
Clients may cancel scheduled services with forty-eight (48) hours notice without penalty. Cancellations made with less than forty-eight (48) hours notice may be subject to a 50% service charge. Cancellation of multi-month contracts requires thirty (30) days written notice. Refunds for prepaid services will be issued within thirty (30) days of cancellation, minus any services already completed and reasonable administrative costs.
To the fullest extent permitted by Colorado law, Legacy Landscaping shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms shall not exceed the amount paid for the specific service in question. Legacy Landscaping is not responsible for damage to existing landscaping, structures, utilities, or property caused by factors beyond our reasonable control.
While Legacy Landscaping warrants that work performed will be done in a professional and workmanlike manner, we make no warranties regarding plant survival, growth rates, or performance. Plant survival depends on factors beyond our control, including weather, soil conditions, maintenance practices, and customer care. We warrant our hardscaping and structural work against defects in materials and workmanship for one (1) year from completion, provided proper maintenance is performed.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in El Paso County, Colorado.
